* Payne, David L.; Priv. Co F,10th KANSAS Inf.; Co. G, 8th Regiment Western
Vol. Inf.; Captain, Co D, 18th KANSAS Cav. Moved to Fairmount Township.
PAYNE, DAVID LEWIS- born 12-30-1836. d. 11-28-82, son of William and Celia
Lewis Payne. In 1859, went west with brother Jack and settled in Brown County,
Kansas. Capt. Payne took part in the border-ruffian war in 1859-60 in Kansas
and Missouri. In 1861, upon outbreak of the Civil War, he enlisted in the 7th
Kansas Cavalry. After the war he served 4 more years with the command of Gen.
George Custer and fought the fierce Comanche Indians through Kansas and Colorado.
Shortley before leaving the military, Gen. Custer offered him a pay increase if
he would accompany the 7th Cavalry against the Souix in Montana. David refused
and returned to Wichita Kansas where he met Rachel Anna Haines, who became his
common-inlaw wife (a common practice of that day) and they had one son George.
In 1865 Capt. Payne was elected to Kansas State Legislature. In 1881 conceived
the idea to start agitation for opening of Oklahoma Territory to settlement.
While orgainzing the 4th invasion of the Oklahoma Territory, he died suddenly of
a heart attack 11-28-84. Less than 5 years later the territory was opened. 110
years later, his family was finally able to move his body to Stillwater Oklahoma
in Payne County (named for him) and a monument was dedicated.

Rhodes, Andrew; Priv. Co G, 57th IN Inf. Was a shoemaker and at beginning
of Civil War, closed his shoe shop and traveled to Kokomo to volunteer
his services mustering in 11-18-61, going at once to the front. He was
killed Dec. 31, 1862, at the Battle of Stone River, being the first man
from Fairmount Township to lay down his life in defense of his country.
His remains were buried in the Stones River National Cemetery, Lot N-5460.
He had married Miss Sarah Mann and fathered 2 children; John L. and Jennie
(for unknown reason, children spelled name as Rhoades, may be due to fact
that gr.father Mann, who raised them, was illiterate). In a letter written
by his son in 1917, he wrote, "I was a small boy but remember quite well
when the stage brought the letter to mother saying my father had been killed
at the Battle of Stone River, on Dec. 31, 1862. He belonged at his death to
Co G, 57th IN Volunteers. After father's death, mother sold the shop (which
was located 1/2 block east of intersection of Washington and Main streets on
south side). We have in our home a ...picture of him in his uniform."
Andrew's wife Sarah (Mann) Rhodes had 2 brothers; John and Andrew Mann (from
Gaston IN )who were in the Civil War. They contracted the measles while in
service and died. Her father Andrew Jackson Mann (of Gaston) also served in
the Union Army during the war. Portrait Grave Marker
