Last Will & Testament of Harvey Gregg Hazelrigg


I, Harvey G. Hazelrigg of the County of Boone and State of Indiana, being of sound mind and disposing memory and desiring to provide for the distribution of such estate both real and personal as I may die possessed of or in any wise entitled to, do hereby make and declare this to be my last will and testament.

First: It is my will that all debts with which my estate may be chargeable with including all funeral arrangements first paid.

Second: It is my will and wish that my body be buried on the north side of the cenetaph erected to the memory of my son Henry L. Hazelrigg deceased and a __ [?] monument placed there, enclosed with an iron fence.

Third: I give and bequeath to my wife Mary Hazelrigg the east half of the north west quarter and the north east quarter of section 20, township 19, Range one west containing two hundred and forty acres more or less to have to hold the same during her natural life and after her death to be equally divided between each of my children as may then be living, which division shall be made by dividing the land or selling it at public or private sale and dividing the proceeds as my executors may think best. I also give and bequeath to her all my stock, grain, hay, carriage, buggy, household and kitchen furniture, fire proof safe, pictures, such of my library as is not hereinafter disposed of and five thousand dollars in money. This bequest to my wife is intended to be in lieu of dower and not in addition thereto.

Four: I give and bequeath to Boone Lodge No 9 of free and accepted masons holding its meetings in the city of Lebanon, all my books and pamphlets relating to the Masonry.

Fifth: I give and bequeath to my grandsons Harvey H. Rawlings, Tommy Rawlings and Freddy Loveless, fifteen hundred dollars each in currency. In case of death of either of said grandsons before the payment is made the amount willed to him of them shall remain with my estate and be disposed of as hereinafter provided for.

Sixth: I give and bequeath my son David W. Hazelrigg my gold had canes [?]. To my son Olley (Oliver) one hundred dollars; To my son John Hazelrigg my gold watch, chain and watch keys

Seventh: I give and bequeath to my son James M Hazelrigg the north east quarter of section eight, Township nineteen of range sixteen in Coffey County, Kansas containing one hundred and sixty acres, more or less to have and to hold the same in fee simple. In the equalization of the division of my land it must be valued at twelve hundred dollars.

Eighth: I give and bequeath to my son George W. Hazelrigg, the east half of the north east quarter section nineteen and the south west quarter of section twenty, both in Township nineteen, range one west containing one hundred and twenty acres, more or less, to have to hold in fee simple; He is to have it at a price to be fixed by the person or persons who value the rest of my land; It must be valued exclusive of the buildings which he has erected or may erect thereon.

Ninth: It is my will that the remaining part of my land in the body on which I now live not disposed of above be divided and allotted as follows: Between Angie Macy, David W., Albert W., children Ollie and John Hazelrigg to wit. The west half of the south east quarter and three and one-half acres off the south west corner of the north west quarter and the east half of the south west quarter all in addition twenty one. Township nineteen range one west shall constitute lot no 1.

This west half of the south west quarter, section twenty one and the east half of the south west quarter, section twenty, both in Township nineteen range one west shall constitute lot No two.

The west half of the north west quarter, section twenty eight Township nineteen Range one west shall constitute 1st No three

The west half of the north east quarter section twenty nine Township nineteen Range one west shall constitute 1st no 4

The west half of the north west quarter section twenty one Township nineteen Range one west shall constitute lot no five

The west half of the north west quarter section twenty one, Township nineteen Range one west shall constitute 1st No six

My executors shall select some competent person or persons to value the above lots separately; The number of each lot with the valuation thereof shall be put on a separate piece of papers, the papers placed in a hat or box and drawn out, one at a time, drawing for the oldest first and so on down till all are drawn out and the person for whom a lot is drawn shall have the same at the valuation thereof in fee simple, and I do give and devise the same. In order to make the division of my land equal there shall be paid to the person or persons for whom the lower priced lots are drawn an amount in currency sufficient to make each equal to the highest priced lots.

Having designated the land I intend for my sons James M. and George W. Hazelrigg, no lot is to be drawn for them, but they are to be taken into the equalization.

Tenth: It is my will that my interest in the house and lot now used by Hazelrigg, Daily & Co [?]as a banking house and any real estate purchased by me hereafter, any corporation bonds and any real estate purchased by Hazelrigg, Daily & Co be sold and a title thereto made. The proceeds thereof to become a part of my personal estate.

Eleventh: It is my will and desire that all my estate not above disposed of shall be equally and impartially divided between and paid in currency to my daughter Angie Macy, and My sons James M Hazelrigg, David W Hazelrigg, George W Hazelrigg, Albert W Hazelrigg, Charley Hazelrigg, Olley (Oliver) Hazelrigg, and John Hazelrigg.

Twelfth: It is my will and I so direct that my executors make a deed to each one of my devisees for the land I have devised to them.

Thirteenth: I hereby constitute and appoint my son David W Hazelrigg and My friends Americus O Daily and James Coombs executers of this last will and testament, hereby annulling and revoking all former wills by me made.
