John Mercer’s Estate

Eli Mercer, Admn.

Comes now Jacob McGinnis, Clerk, and reports to the Court, that heretofore, towit, on the 1st day of February, 1856, he granted letters of Administration on the estate of

John Mercer, late of said county deceased, to Eli Mercer, and took bond in the penalty of three thousand dollars, with Henry E. Cowgill as his security

It is therefore ordered by the Court that the granting of the said letters and the taking of the said bond be approved, ratified, confirmed, and adopted as the act of this Court. And this cause is continued.

John Mercer’s Estate

Eli Mercer, Admn.

Comes said Administrator by John Hanna his attorney and moves the court for leave to make a final settlement of the business of said estate and files his settlement sheet herein, which, with accompanying vouchers, being excercised, is approved by the Court and ordered to be recorded; and ordered that said Administrator stand charged and credited as herein set forth; and the said settlement sheet is in these records and figures, to wit: State of Indiana Putnam County Putnam Court of Common Pleas December Term A. D. 1859. To the Honorable the Judge of said Court: The undersigned Eli Mercer Administrator of the estate of John Mercer late of said county deceased would by leave to present the following final settlement. Report of the Administrator of said Estate. Said Administrator states that by reference to the several reports by him heretofore made, it will be seen that on the first day of September 1859 the balance which was then shown to be in his hand was $586. 57

Said Admn claims the following credits since his last report to wit:

1. To Eli Mercer Adm. as per bill 22. 00

2. To Mel McKee Clerk 2. 50

3. To John Hanna 10. 00 = 34. 50

Balance of distribution is $560. 86

The last said John Mercer left a widow Ruth Mercer and ten Heirs as follows:

1. The minor Heirs of Rachel Overton; John Overton Guard.

2. David Mercer

3. Eli Mercer

4. Thomas Harper and Elizabeth Mercer his wife

5. Seth Mercer

6. John Mercer

7. James Mercer

8. William Pascal and Mary Jane Mercer his wife

9. Daniel A Mercer

10. Hamilton Mercer

By reference to former Reports it will be seen that the Admn has of the moneys which have heretofore come to his hands paid to the widow and heirs the sum of $139. 38 according to their respective interest and share therein which in the distribution of the present sum he takes no notice of. That in addition thereto he paid to John Overton the Guardian of said Rachel’s minor heirs the sum of $16. 00 which sum added to the amount now shown to be on hand makes the entire sum for the distribution the sum of $576. 86 which belongs to the respective heirs in the sum following that is to say

To Ruth Mercer the widow 1/3 $192. 202/3

1. To John Overton Guard of Minor heirs of Rachel Overton 22. 50 Paid

2. David Mercer 38. 45 Paid

3. Eli Mercer 38. 45 Pd

4. Thomas & Elizabeth Harper 38. 45 Pd

8. William & Mary Jane Pascal 38. 45 Paid

9. Daniel A. Mercer 38. 45 Pd

The Amt of which on hand paid into Court $560. 86 Said Administrator now pays into Court this entire sum of said balance shown to be in his hand, for distribution and asks that the Clerk be ordered and directed to pay to the respective heirs and widow the sums thus shown to be due them on first settlement. He would further represent to the Court that in a certain action wherein Layman & Layman was Plaintiff and one of said heirs to wit Seth Mercer was defendant said action commenced and tried before Esq Minnick of Warren Township he said Administrator was su- - - - - - as garnishee in said cause and as such garnishee he was by the judgment of said Justice orderd to pay to the plaintiff in said cause whatever sum might be found to be coming to said heir in the hands of said Admn on first settlement the amt of said claim being $38. 33 a copy of which judgment and proceedings are filed herewith. Said Adm. therefore brings these facts to the knowledge of the Court in order that the Court may order and direct the Clerk as to said heir to pay to said plaintiffs in said cause said money to the amt of $38. 33 instead of paying the same to the heir and to make such order in the premises as will save him said Administrator (hardship?). Said Admn now asks that this his final settlement be approved and that he be discharged from all further duties and liabilities in the premisises. All of which is repectfully submitted. Eli Mercer ---- Subscribed and sworn to in open Court, December 5th 1859, Mel. McKee, Clerk, Pr. M. V. Rudisill (D. C. ?)

And on further motion it is ordered by the Court that said account of said Administrator, amounting to the sum of twenty two dollars, be allowed, and said Administrator now pays into Court the sum of Five hundred and sixty dollars and eighty six ($560. 86), and on motion the Clerk is ordered to pay to the widow and heirs the several amounts to which they are shown to be respectively entitled by said Report, except as to said heir, Seth Mercer, and as said Seth the Clerk is ordered and directed of distributive share to pay to Layman & Layman the sum of $38. 33 as they said Layman & Layman had garnisheed that sum in the hands of said Adminstrator, as more particularly shown by the record of said cause on the Docket of Esq Minnick of Warren Twonship. And on further it is orderd by the Court that the said Administrator be forever exonerated, discharged and quieted from all further duties and liabilites as such. December 11, 1859 received of Mel. McKee, Clerk Thirty eight 33/100 Dollars ($38. 33), in full of the amount garnisheed by us in the hands of said Admn
