Hyten, John S - estate suit

A suit has been filed in the circuit court by John Goff, administrator of the estate of John S. Hyten, deceased, against Rachel Hyten, widow and the remaining heirs. The complaint alleges that as admin Mr. Goff came into possession of $442.55 of the personal property of the decedent and that claims have been filed and will be filed aggregating $945 and that the personal estate will not pay the claims. It is asked that the real estate of the decedent be sold. This real estate is encumbered with two mortgages, one given to Depew Hyten to secure him because of the signing as surety of noted aggregating $410. There is also a mortgage given to the National Bank of Romney for $3200. It is stated in the complaint that the widow’s share of the real estate and personal property are liable with the remainder of the estate and the suit is brought to foreclose the mortgages and sell the real estate .
