Dazey - Samuel - partition suit

An interesting partition suit is on trial in the circuit court. Its title is Emma Binns vs. Sarah Dazey et al., the defendants being the heirs of the late Samuel Dazey. Mrs. Binns is the daughter of Malone Dazey, who was raised in Samuel Dazey’s family and who was generally supposed to be his son. He undoubtedly was the son of Mrs. Samuel Dazey. Mrs. Binns was excluded from a share in the estate by the undisputed heirs of Samuel Dazey and brought suit for a partition of the property, claiming that her father was one of the rightful heirs and, that he being dead, she should share in the estate. The case is now on trial and on Wednesday the deposition of Mrs. Samuel Dazey was read. It stated that Malone was not the son of Samuel Dazey, but of a brother of his. Malone was born two years before her marriage to Samuel Dazey.
