FRANK KINCAID SUES MONON FOR DAMAGES

Because a freight train backed into his buggy demolishing the buggy and harness and crippling the horse and himself, Frank Kincaid wants to recover $1,000 damages from the Monon Railroad. A complaint asking that amount was filed in circuit court for him this morning by his attorneys, Whittington & Williams. The complain alleges that on the evening of October 2 between the hours of 4:30 and 7:00 the plaintiff attempted to cross the track of the defendant on Main Street. The north bound local freight had been left standing partly on the crossing and of the 60' of the street only about 15' was left available for vehicles and pedestrians. Seeing three other rigs drive across the track in the rear of the caboose, Kincaid says he attempted to do the same but the train was started backward without warning and smashed his buggy. He was injured about the back and abdomen and since that time, he avers, has not been able to do manual labor though previous to that time he was capable of earning $3-$5 a day. He recites that the train was left blockading the crossing expressly in violation of city ordinances which provide a penalty of $50 for obstructing streets. - typed by kbz
