In the name of God Amen I, HENRY GATES, of the County of Tippecanoe in the State of Indiana knowing the certainty of death and the uncertainty of the time thereof and to the end I may be the better prepared to leave this world do make and declare this my last Will and testament hereby Revoking and making void all former wills by me at any time heretofore made.

First and principally I commend my soul to God and my body to the earth at the discretion of my children hereinafter named and as to the worldly estate wherewith it has pleased God to entrust me I dispose of in the following manner. I Direct that all Just Debts as shall be by me owing at my Death Together with my funeral expenses and all things touching the providing of or otherwise carrying into complete effect this my last will and testament be out of my estate fully paid and satisfied and after payment thereof and subject thereto I give and bequeath to my beloved wife ELLEN GATES the use of all my estates during her natural life in the following manner to have the house in which I live with five acres of ground upon which it stands with the privilege of fire wood of the rest of the farm for her use and comfort together with the rents and profits of said lands together with all my personal estate to have and to dispose of the same for her use and benefit during her natural life and if at any time she should feel like making donations to any of her children that she donate to those then living and at the death of my wife all of my real estate shall be equally divided between my children ROSAND LONGNECKER, JAMES GATES, JOHN GATES, HENRY GATES, MINERVA E. GATES, WILLIAM GATES, HARRISON GATES, SAMANTHA ELSIE GATES, and at the death of my wife I will and bequeath all my personal estate to my two youngest children HARRISON and SAMANTHA E. GATES and I further will that none of my heirs shall cut or remove any timber of from said lands and lastly I hereby make and ordain that JAMES M. STOCKTON be my Executor to prove and carry into complete effect this my last will and testament. In witness whereof I, HENRY GATES, the testator have hereunto set my hand and seal this third day of September in the year of our Lord 1862.

Signed, sealed, published and delivered by the above named HENRY GATES the testator as his last will and testament in the presence of us who have hereunto subscribed our names as witnesses thereunto in the presence of the testator and in the presence of each other this day and year first above written.
