Final Report, 1898

Note: Clara Gates was 18 years of age at her death in 1893.  She was the daughter of Harrison Gates and Fannie Charlott.

Comes now JOHN L. MITCHELL administrator of the estate of CLARA GATES deceased, in proper person and by A. ORTH BEHM his attorney, and the Court being fully satisfied that due and legal notice by publication and posting has been given of the hearing of the final report in this behalf, said final report is now submitted to the Court for hearing upon oral and documentary evidence.  And the Court being fully advised in the premises find that the report made is a full true and final settlement of said trust and should be approved and said administrator discharged and the estate declared settled.

And the Court does now approve the said report and does now order adjudge and decree that said report is a full and final settlement of this trust, that said administrator be allowed the credits to him claimed that said estate is fully settled and that said administrator be and he hereby is fully and finally discharged from all liability on account of his said trust.

And the Court further finds that said decedent left her surviving as her sole and only heirs at law the following persons to wit:

JAMES GATES who was an uncle of said decedent

JOHN GATES who was an uncle of said decedent

MINERVA GATES who was an aunt of said decedent

SAMANTHA E. MITCHELL who was an aunt of said decedent

ROSA FOX and FRANK GATES who were children of HENRY GATES deceased and who was an uncle of said decedent.

WINNIE MAY MILLER, JESSE MILLER and ORA MILLER who are the children of ELLEN MILLER deceased who was an daughter of said HENRY GATES deceased.

RETTA LONGNECKER and JOHN STANFORD who are grandchildren of ROSE ANN LONGNECKER deceased who was an aunt of said decedent.

EDWARD GATES, PERRY GATES, MARTIN GATES and WILLIAM GATES who are the children of WILLIAM GATES deceased who was an uncle of said decedent.

And the Court further finds that said administrator had paid to the clerk of this Court for distribution the sum of One Hundred and Twenty Seven and 12/100 Dollars ($127.12), and does now order adjudge and decree that the money so paid in be distributed as follows to wit:

MINERVA GATES          1/7  or  $18.16
SAMANTHA E. MITCHELL   1/7 or  $18.16

ROSA FOX               1/3 of 1/7  or  $6.05 1/3
FRANK GATES            1/3 of 1/7  or  $6.05 1/3

MINNIE MAY MILLER      1/63  or $2.0139/63
JESSE MILLER           1/63  or $2.0139/63
ORA MILLER             1/63  or $2.0139/63

RETTA LONGNECKER       1/2 of 1/7  or  $9.08
JOHN STANFORD          1/2 of 1/7  or  $9.08

EDWARD GATES           1/4 of 1/7  or $4.54
PERRY GATES            1/4 of 1/7  or $4.54
MARTIN GATES           1/4 of 1/7  or $4.54
WILLIAM GATES          1/4 of 1/7  or $4.54


And the Court further finds that WINNIE MAY MILLER, JESSE MILLER, ORA MILLER and JOHN STANFORD are minors under the age of twenty one years and does now order adjudge and decree that the said amounts found to be due the said minors WINNIE MAY MILLER, JESSE MILLER, ORA MILLER and JOHN STANFORD by by the Clerk of this Court deposited in the Lafayette Savings Bank of Lafayette, Indiana the credit of said parties entitled thereto.  And the Court further orders that the sums due the other others be paid by the Clerk of this Court to them sevearlly, upon their receipting [sic] on the Order Book of this Court therefor.
