The last will and testament of Michael Summers of Tippecanoe County and State of Indiana. I will and bequeath to my blood wife Ruth, all my household furniture together with every article that pertains to the household furniture. Secondly I will to her one third of my real estate to be laid off according to her wish and to be used by her agreeable to her will during her life. Thirdly I will her two cows her choice of my stock, also eight head of sheep her choice of my flock. Fourthly I will that my executor furnish her with other means to obtain all provisions necessary for the support of herself and family for one year. After the fulfillment of the above part of my will I desire my executor to sell to the best advantage in his judgement any personal property remaining for cash and pay off all cash debts standing against my estate, the remainder of my personal property after paying all debts to be sold on the usual credit, after the proceeds of the same is due and collected, I will that my executor pay to my daughter Ady the sum of fifty dollars out of the same if there be a sufficiency, if there be not a sufficiency I will he shall make it up to her out of any other means in his hands. If there should be anything left of the proceeds of my personal property I will it equally divided among my heirs. After setting apart that part of my real estate willed to my wife I desire my executor to rent out the remainder to the best advantage and divide the proceeds among my heirs until my younger child arrives at the age of twenty one years, at which I will it or its proceeds equally divided among my heirs accept one half acre cal'd the graveyard which I will to my executor and his representatives for the use of a burying ground. I hereby appoint Phillip Summers executor of this my last will and testament made and signed this 5th day of Oct. in the year of our Lord 1848.Michael Summers

Tippecanoe CountyOn this 27th day of November A.D. 1848 in open court in the Probate Court of Tippecanoe County personally came Samuel Harrison and Robert R. Drake the subscribing witnesses to the forgoing instrument of writing purporting to be the last will and testament of Michael Summers deceased and each bring duly sworn to testify to the truth the whole truth and nothing but the truth concerning the execution of said last will and testament, upon their oaths testify as follows to wit, that they saw the said Michael Summers in his lifetime sign said instrument and publish the same as his last will and testament, and that they each subscribed their names thereto as witnesses in the presence of said testator and by his request, and in the presence of each other and that said testator at the time he so signed and published said will as aforesaid was of full age to devise his property and was of sound mind and memory, and was not under coercion or restraint, all of which they verily believe and further say not.

Drake has been made in will record numbered two pages 95 and 96 as appears from said Record now remaining in my office. In testimony whereof I have hereunto set my hand and affixed the seal of said court at Office in Lafayette on this 27th day of November A.D. 1848.
