Service: Mecklenburg County NC - served under Capts. Rease; Wm. Hutchinson and Samuel Martin with Cols. Caleb Phifer and Wm. Polk - battles of Eutaw Springs, Moncks Corner, Hanging Rock, King's Mountain and Cowpens.

Married in 1793 Eva Cotner. Children: Henry; Daniel (married Mary Wells); Jonathan (married Mrs. Mary Holmes Askew); Solomon; Sarah (married Joseph Wells); Rosa (married Stephen Wells); Eva married Mr. Henshaw; Mary (married Jesse Burnett); Peter who married Mary E. Wells.

I, Peter Stoner, of Putnam County, Indiana considering the uncertainty of life, and being of sound disposing mind and memory do make and publish this my last will and testament, hereby evoking and making void all former wills by at any time heretofore made.
1st, I will and direct that all my just debts be paid and my funeral expenses also out of the first money that comes to the hands of my executors.

2nd I will and direct my wife, Eve Stoner after my death, shall have, during her material life, as much as she may need, of the proceeds of my home farm being the NW 1/4 Sec 26 in Twp 14 North of Rang (sic) five west in Putnam County

3rd I will and direct that my son Jonathan Stoner and his heirs have at my death, the above named farm containing 160 acres, forever, on condition that he support me and my wife till my death and after my death pay to my executors (or to me in my life time) the sum of $1200 to be paid in four yeaers after my death.

4th Having given my son, Henry Stoner his share of $500 he is to have no more of my estate until all the specific bequests are paid when he is to have his share of the surplus of my estate.

5th I will and direct that Daniel Stoner, my son have $17 and the note I hold on him for $33 which will make him up the sum of $500.

6th I give and bequeath my son Peter Stoner and his heirs forever after my death the SE 1/4 of Sec 13 Twp 14 North of Range Five West on condition that he pay to me in my life time or my Executors after my death $100 in one year after my deaht

7th I will and direct that my daughter, Rosanna Wells, Eve Hasty and Polly Burnett have each the sum of $300 to be paid after my death by my executors.

8th I will and direc that the heirs of my late daughter, Sarah Wells have the sum of $300 to be paid out of the first money that comes to the hands of my executors (not beofre appropreated ? and to be equally divided between said heirs or grandchildren

9th I will and direct that the surplus of my personal property (except my wagon, tools and farming utensils, which I give to my son Jonathan after paying off the legacies and bequests before made and all costs of administration be equally divided between my heirs

10th I hereby make and ordan Levi Mann and Peter Stoner Executors of this my last will and testament, having hereby revoked all other wills and testaments heretofore made by me. I witness whereof I, Peter Stoner have hereunto set my hand and seal this 10th day of January in the year of our Lord eighteen hundred and fifty one. Peter Stoner - Seal

Signed, sealed and published and declared by the aforenamed Peter Stoner as his last will and testament in the presence of us who have at his requests hereunto subscribed our names as witnesses in the presence of the said testator and in the presence of each other.

Isaac Mathews (?). Andrew Frank, James ANderson - State of Indiana Putnam County etc; Before me, Jacob McGinnis clerk of the Probate Court said county on this 12th day of April 1851 personally appeared Andrew Frank and James ANderson two of the subscribing witnesses to the foregoing last will and testament of Peter Stoner late of said county, deceased who being by me duly sworn upon their oaths deposisions and say that the foregoing last will and testament was duly executed by said testator that said testators name was subscribed there by his request express direction that at the time of executing the same the said testator was of lawfull (sic) age to devise his property and of sound mind and memory and not under any coertion of restraint whatever that the said testator declared the same to be his last will and testament and that the same was signed by his direction and the presence of these deponents and said Mathews (Matkins??) and that these deponents and Isaac Matkins the other subscribing witness that subscribed their names as witnesses thereto in the presence of said .. at the request of said testator and in the presence of each other - Andrew Frank - James Anderson before me the date above witness my hand and the seal of said court - hereto affixed at Greencastl the state above - Jacob McGinnis, Clerk
