JENNINGS COUNTY RECORD BOOK
NUMBER 1, 1817 to 1829
The following is a
transcription of the oldest record book I have found at the Jennings County
Courthouse, this one is especially difficult to read and begins with a List of
Officers both Civil & Military who were in put in place when the County
organized in 1817. The book is transcribed as it is written or as close as I
could come-dates that are out of order are as they are in the book. ? means I
am not sure of spelling or the word. These records are in the front of the book
at the Courthouse marked as Marriage Book 1.
This book is now complete.
James Wooley Esq. took the oath now
Effectually to prevent dueling also the oath of office as Justice of the Peace
for Jennings County on the 8th July 1817 before the Hon. Wm. Prather a
Judge.
Capt. Jeremiah Talbott took the oath
now Effectually to prevent dueling together with the oath of office before
James Wooley Esq. on the 4th day of August 1817.

Lieut. James Clark also Thomas Collins Ensign took the same oaths at the
same time before James Wooley Esq.

following bonds and securities be rec. as sufficient from the clerk and recorder
of this County.
Know all men by these presents that James Stott, Zenas Kimberley, James Hobbs,
Joseph M?inton and Isiah Blankenship acknowledge ourselves to give and be
Indebted unto Jonathan Jennings & his successors in office the Penal and the
full sum of Two Thousand five Hundred Dollars lawful money of the State of
Indiana to be Service of Goods and Chattles jointly and severaly witness whereof
we have set our hands and seals this 6th day of April 1818.
Now the condition of the above ? is such
that the above Bound James Stott shall well and full Perform his duty according
to Same as Clerk of the Jennings Curcuit by recording all the orders of
said Court seasonably and in good time by paying over all monies into the hands
of the proper persons entitled to receive it that may come into his hands by
virtur of his office aforesaid. Then the above obligation to void or else remain
in full force by virtue Witness our hands and seals this day and date above

Whereas Wm. Wells adminstrator of all and singular the
goods and chattles of Wm. Wells dec. has not returned a satisfactory list
of the said decedent Estate ordered that he is ruled to appear here on the next
term of the Court and render an account of his administration.
Whereas Zenas Kimberly Esq. took
out letters of administration on the 22nd day of Octor 1819 of all and singular
the goods and chattles of Levi Reed deceased. Ordered that the following
appraisement list and bill be received and recorded-Joshua C. Cheiver and Samuel
Pettis appraisers.
Know
all men by these by these presents that we James Stott, Zenas Kimberley, James
Hobbs, Jonathan Blankenship acknowledge ourselves to owe and be indebted to
Jonathan Jennings Governor of the State of Indiana in the Penal sum of Fifteen
Hundred Dollars to be levied of our Goods & Chattles respectively this 6th
day of April 1818.
The condition of
the above obligation is such that if the above bound James Stott will well
and truly perform his duty as recorder agreeable to law then the above
obligation to be void or else remain in full force & virtue witness our
hands and seals this day and date above written.

This day the honerable William Prather appeared at the
place of holding Court in the town of Vernon and no other judge appearing to
form a Court, it is ordered that the court stand adjourned until Court in
Course.
November term 1818
At a Court held in and for the County of Jennings at the
Courthouse in Vernon the second day of November 1818

Whereas Elen
Wells and of the Clerks office of this Court letters of administration on
the Estate of William Wells deceased on the 18th day of June last together with
William McClay? and Chauncy Butler as securiters
which letters and secur are approved by the Court and this
day the aforesaid Elen Wells administrator of said Estate produced an
inventory amounting to Four Hundred Fifty Five dollars $455 which is ordered to
be recorded and the property filed in the Clerks office whereupon it is
ordered that this Court stand adjourned until Court in Course.
Probate
Court March 8, 1819-this day the Honerable William Prather one of the associate
judges of said County appeared & Court being open but no other judge
appearing said Court stands adjourned until Court in Course.
June Term
1819
At a Probate Court
began and held in the County of Jennings and Town of Vernon on Monday the
6th day of June 1819
Present William Prather Associate Judge of said County and
after Court being opened Jonathan Barrett Esq. produced a Commission
from under the hand & seal of the Governor of this state as an
Associate Judge with an Endorsement on the back thereof from under the
hand & seal of A. Vawter Esq. setting forth that he the said
Barrett had taken the necessary and lawful oaths as an associate Judge of
said County and took his seat accordingly.
Be it remembered that heretofore to wit on the 23rd day of
March 1819 John Vawter obtained letters of Administration on all an singular the
goods and chattles of Saml. ? Roby from the Clerks office of the County of
Jennings which letters are confirmed and ratified and the said John Vawter
is duly authorized to act as administrator of Saml. ? Roby deceased and list of
sale of said Roby property be received and all filed in the Clerks office and
whereas it is representated that the personal property of Samuel ? Roby is not
sufficient to pay his debts and ?
all his real
estate it is ordered that the administrator be authorized to sell on a
credit of six months One lot in the Town of Vernon known on the platt
of said town as no 4 and appropriate the money for the purpose of securing
the balance of the his the said dec. real estate and that the Clerk make
out form notices and give to the Sheriff for publication at least twenty days
previous to the first Saturday in July next.
Whereas it appears to the satisfaction of this Court that
Edward Corns? obtained letters of administration on all and singular
goods and chattles of Phebe Corns deceased from the Clerk of the office of the
County of Jennings on the 8th of March 1819 which letters are hereby confirmed
and ratified and the said Corns this day comes into Court with an inventory of
said Estate signed by Joseph Biggs and John Boner with a Certificate
from under the hand and seal of A. Vawter Esq. certifying to their having
been duly sworn which inventory amounts to $125-25 as per original
left on file in the Clerks office and which property the said administrator kept
at the appraisement value and returned into court to rebut the same. To
maintaining the said Phebe Corns deceased, she being old and infirm for five
years & six months at the rate of twenty dollars a year expenses
totalling $136.877 which account was allowed said Edward Corns administrator
aforesaid and ordered to be recorded accordingly. Whereupon the Court
adjourned until Court in course.
At a Probate Court began and held
in Vernon on the 11th day of October 1819
Present the
Hon. William Prather and Jonathan Barrett Associate Judges of the County of
Jennings and State of Indiana aforesaid
On motion of John Lampson he producing Power of Attorney
from under the hand and seal of Thomas Roby of Pittsfield, in the County of
Cumberland and State of Massachusetts certifying that he the said Thos Roby
was duly appointed and authorized to administer of all and singular the goods of
Saml Roby deceased by the Hon Lamb Freeman Judge of Probate within & for the
County of Cumberland in the state which appointment of said Judge was duly
certified by John Brooks Esq. Governor of the State of Massachusetts.
Ordered by the Court that John Vawter to whom letters
of Administration was heretofore granted in the Court of the aforesaid decedents
Estate have full power & lawful authority to administer upon the ? be
authorized to settle said Estate with the aforesaid Lampson &
deliver over all the assetts papers and documents appertaining to the said
decendents Estate unto the aforesaid John Lampson of the State of
Massachusetts aforesaid
Ordered that the Clerk make out
all the necessary papers and records concerning the Estate together with
the Inventory and Orders. Whereas John Lampson Esq. of the State of
Massachusetts has come forward in open Court and acknowledged that he has
received of John Vawter Esq. all the papers claims and credits belonging
to the said decedents Estate we do hereby discharge him the said A Vawter from
all Errors and Responsibility on his part. List of buyers at sale of Samuel

by Daniel Collins the same person who gave the receipt above mentioned one
broad ax, one drawing knife, one square, one compass, one adz, 4 augers &

In the affidavidt
and petition of Zenas Kimberley administrator of Levi Reed it is ordered that he
sell sixty acres of land belonging to the said decedants Estate it being
the South side of the NE Quarter of section 4 town 6 R8 for the best price that
can be had for the same, Thirty dollars to be paid in hand and a credit of ?
months for the Balance provided the purchaser gives bond with good and
sufficient security, said sale to be on the third Monday in September next.
Elen Wells administrator William Wells deceased comes and
exhibits the following list of additional inventory-Ordered by the Court that
whereas Elen Wells administratix of the Estate of Wm Wells has Married with
Justis Rich that he give an additional bond with two good and sufficient
Security for the faithful administration of said Estate.

This day Justis
Rich appears in Court persuant to an order of last term and enteds into bond
with Z. Kinberly and E.F. Pabody his secutiry for the faithful performance of
his administration.
Ordered that Adam Kellar be appointed and he is hereby
constituted guardian of Valuntine Brougher according to law and the
usage of this State.
Persuant
to an order of the last Probate Court authorizing Z. Kimberly
administrator of the estate of Levi Reed to dispose of a certain parcel or tract
of land belonging to the said decd this day he returns into court upon his oath
as administrator aforesaid that he has offered the south part of the north east
quarter of section 4 in town 6 north in range ? east and has sold the same
to Wm Sanford for 1 dollar and 81 1/4 cents per acre--amount in whole
$108.75 which sale is approved by the court and the said administrator is to be
credited accordingly.
Z. Kimberly administrator of the estate of Levi Reed
charges himself with $8-46 for tools sold belonging to said decedents
estate which came to his hand subsiquent to the first sale.
Ordered that William Prather and
Jonathan Barrett Esqrs associate judges be allowed two dollars each per day
for attending as judges of this Court this day.

I John Miller Sr. of the Township of
Montgomery Jennings County and State of Indiana farmer being very sick and weak
of body but of perfect mind and memory thanks given unto God calling to mind the
mortality of my body and knowing that it is appointed of all men now to die do
make and ordain this my last will and Testament that is to say pricipally and
first of all I give and recommend my soul into the hand of almighty god
that gave it and my body I recommend to the earth to be buried in decent
christian burial at the discression of my executors and nothing doubting that at
the general reserrection I shall ? the same again by the mighty power of God and
touching such worldly estate wherewith it hath pleased God to bless me with in
this life I give devise and dispose of the same in the following manner and
form
First I give and bequeath to Jane Miller my beloved
wife my right and title to the South west quarter in section No. 11 Town five
north range eight East also thirty five acres of land in the west of the South
east quarter in the same section with all my moveable property and household
goods with all my farming ? with all debts and money in possession for her
to have and to hold during her widowhood for the purpose of paying for said
land and for raising and schooling my children ? as she make proper until the
year one thousand eight hundred and thirty six then said land and all the
moveable property to be sold reserving one third of the property for her support
during her natural life the other two thirds equally divided among my
children I likewise constitute make and ordain my beloved wife Jane Miller my
executris and my son James Neil Miller executor of this my last will and
testament.
In witness whereof I have
hereunto set my hand and seal this twenty ninth day of January in the year of
our Lord one thousand eight hundred and twenty two.

At a Probate Court held in Vernon
in and for the County of Jennings on Monday the 15th of July AD 1822
present the honerable William Prather and Jonathan Barrett Esqrs associate
judges of Jennings County,
The Court was opened at the
Courthouse of J County and it was ordered to be adjourned to the dwelling house
of James Stott.
Now whereas John Miller late of Jennings
County deceased and in his last will and testament did constitute ordain and
appoint Jane Miller
his executrix and James Neil Miller
his executor who have during vacation of this court produced said last will and
testament of said John Miller deceased and proven and entered into bond in the
Penal sum of two thosand dollars together with Thomas Graham and James Hobbs
their security letters testamentary were granted them by the clerk of the
court which said letters are ratified and approved of.
On motion of John Boner for
to obtain letters of administration on all the goods chattels credits rights
moneys and effects of Gilbert Sutfin late of Jennings County deceased and it
appearing to the satisfaction of of the court that he is next of kin and the
right of administration of right to him belongs therefore letter is granted into
him by his entering into bond in the Penal sum of four hundred dollars
together with Achilles Vawter and John Russell his security

James Hobbs and Joseph Biggs are appointed to appraise
the goods chattels and effects of Gilbert Sutfin late of Jennings County
deceased and make a true return thereof to the next session of this court.
Ordered that William Prather and

this Court.

Peleg Baker:s Will
In the name of
God Amen, I Peleg Baker of Jennings County and State of Indiana being feble of
body but of sound mind and memory do make and declare this to be my last will
and testament-That is to say-
I will and bequeath to my
son Joel Baker the sum of ten dollars to my son John Baker the sum of fifty
dollars to my sons David and Jonathan Baker the sum of eighty dollars each To my
daughter Anna Burton the sum of thirty eight dollars to my daughter Patsey Potts
the sum of ten dollars to my daughter Susanna Davis the sum of twenty dollars to
my daughter Betsy Baker the sum of seventy dollars and to my daughters
Nancy and Mariah Baker the sum of fifty dollars each after my children
above named shall have received the sums assigned to them severally I
further will and bequeath to my children including my sons William and
Stephen Baker and my daughter Sally Spears with those above named the balance
and remainder of my real and personal property to be divided equally among them
and I moreover hereby appoint my friends and neighbors Basil Meek & Joseph

day of May last past Mary Rogers widow of John Rogers deceased obtained letters
of administration on said estate from the clerks office in vacation by
entering into a Bona Conditionea as the law directs together with
James Buckles and Ebenezer Brandon as security for her faithful
administration on the aforesaid decedents Estate which letters are
confirmed And now this day the above named Mary Rogers returns into Court the
following list of property of the said decedents Estate duly signed by
Chapman Denslow & John Hopkins two of the appraisers as aforesaid which list

Sheilds & James Elliott Securities which said Bond and letters are
hereby approved by the Court now here and the aforesaid administrator
William J Sheilds one of the administrators produces into court the

Joseph English as appraisers of said estate together with a list of a sale of

weak in body but of perfect mind and memory Thanks be given unto God.
Calling to mind the mortality of my body and knowing that it is appointed unto
all men once to die do make and declare this my last will and Testament and
desire that it shall be received by all as such that is to say principally
once first of all I give and recommend my soul unto the hands of Almighty God
that gave it and my body I recomend to the earth to be buried in a decent
Christian burial at the descretion of my Executor and nothing doubting but at
the General Ressurection I shall receive the same again by the almighty
power of God.
And as touching such worldly
estate as it hath pleased God to bless me with in this life I give devise
and dispose of the same in the following manner in form First I give and
bequeath unto Polly Shepherd my beloved wife the improvement whereon I now live
containing twenty acres during her widowhood with all my household and kitchen
furniture and four head of horses and eighteen head of cattle. I give and
bequeath unto my daughter Rachel Clem one dollar and to my daughter Patsy
Denslow one dollar and to my son William Shepherd one dollar and to my son
Joshua Shepherd forty acres of land lying on the west side of my quarter where I
now live and to my daughter Betsy Shepherd one cow and calf I give to my son
Amos Shepherd and James Shepherd and to the child that my wife is now pregnant
with if it should be a son the seventy acres of land to be sold and the
proceeds of the sale to be equally divided between them I give to my daughter
Frances one bed and furniture and one cow and calf when she comes of age and to
my daughter Hety Shepherd one bed and furniture and one cow and calf when
she becomes of age and to my daughter Melitta Shepherd one bed and furniture and
one cow and calf when she comes to be of age and to my daughter Emily
Shepherd one bed and furniture and one cow and calf when she comes to be of age
and to the child that my wife is now pregnant with if it should be
a Daughter one bed and furniture and one cow and calf when it comes
to be of age I likewise constitute make and appoint and ordain my beloved wife
Polly Shepherd my Executrix and my son William Shepherd my Executor to this

Honerable the Probate Court for the County of Jennings met at the Court House in
Vernon on the 26th September 1823 persuant to adjournment the same judges
present.
John W. Green exhibits
a claim in the sum of four dollars in Kentucky paper against the estate of
Nathan Meek deceased as paid for him in his lifetime, which being duly
proven. It is ordered that he be allowed therefor the sum of two dollars.
(interesting does this mean that
Kentucky paper was worth 1/2 the amount of a dollar?)
Ordered that the claim heretofore allowed against the
estate of Nathan Meek deceased by a set off against a note due from said Green
to said estate or a judgement that shall be obtained upon said note.
An additional list of
property belonging to the estate of Nathan Meek deceased sold by the
administrator on the first days of Feb 1823.
The court finds that property has come into the hands
of William Meek administrator of the estate of Nathan Meek deceased
amounting to the sum of $127.481/2 and that he hath this day exhibited to
the court the following notes also the following amount for services about the

And upon settlement and adjustment of amounts it is found
that eight cents is due the estate from said admininstrator.

of all and singular the Rights Goods & Chattles of Joshua Meek decd which
