I, John A. Baer, of Tippecanoe County, Indiana, being of sound and disposing mind and memory, but in uncertain health, hereby make this my last will and testament, hereby revoking all former wills by me at any time heretofore made.First: I give and bequeath to my beloved wife Martha J. Baer six hundred dollars in lien of the five hundred dollars allowed by law.
Second: I give, devise and bequeath all of the real estate of which I may (illegible) to Martha J. Baer (my wife) and my younger children Roscoe A. , Joseph A., Clarence H., Bertha M. and Bertie A. Baer, as tenants common and in fee simple, share and share alike. But should my said wife Martha J. Baer elect to take her statutory right to the life estate in the undivided
one third of my real estate, then the said Roscoe A., Joseph A., Clarence H. Bertha M. and Bertie A. Baer shall take the one third in fee simple, share and share alike, subject to said life estate of said Martha J. Baer, and all the rest (illegible) and remainder shall go to said Roscoe A., Joseph A., Clarence H. Bertha M., and Bertie A. Baer in fee simple, share and share alike.Third: In case the said Martha J. Baer, my wife, shall accept the provisions of my will above making her an equal tenant in common with my children in my real estate, then she shall have and take all such articles of household property as she may elect.
Fourth: It is my desire that none of my real estate shall be sold to meet indebtedness of my personal estate shall be found aside for the bequeath in paragraph first above, sufficient to meet the same. And it is my further express desire that my said children shall hold their share of my real estate undivided and shall not sell or dispose of the same until the youngest of my said children above named shall have attained the age of twenty-one years.
Fifth: I nominate my beloved wife Martha J. Baer and my friend Newton R. Johnson, the executors of this last will and testament.
In testimony whereof I have here unto set my hand and seal this 29th day of December 1900.
Signed sealed and declared by the above named John A. Baer, as and for his last will and testament in that presence and in the presence of each other, and we have in his presence, at his request signed our names as witnesses thereto in the presence of each other this 29th day of December 1900.
