Ezra Smythe of Greencastle is for the second time within the past few months the plaintiff in a suit for divorce from his wife, Gertrude Smythe. The complain filed on Monday morning by Allee & Hughes, the attorneys for the plaintiff alleges that Gertrude Smythe has long treated said plaintiff in a cruel and inhuman manner, and that being unable to bear such treatment he filed suit for divorce that later a compromise was effected wherein it was agreed that the parties to the suit should treat each other kindly and the suit was dismissed. It is alleged that the defendant immediately renewed cruel and inhuman treatment of plaintiff nagging and tantalizing by threatening to sue for divorce and vowing that she did not want to live with him. Mr. Smythe asks for a decree of divorce and the custody of the minor children.

After hearing the evidence in the case of Ezra Smythe, who was suing his wife for divorce, Judge Hughes this afternoon granted the divorce to Mr. Smythe. Mrs. Smythe was given the custody of her two minor children. Mr. Smythe is to pay $25 a month toward the support of the children. The property interests were settled out of court. Besides $1100 alimony Miss Smythe receives $1800 residence property on South Indiana Street.
