Said
Administrator shows to the Court that the above report contains a full and
complete Statement of all of said Estate which came to his hands to be
administrated together with the credits which he is entitled that at the March
Term of the said Court 1881 he filed this petition in said Court to sell a
certain certificate of purchase executed to him the Sheriff of said Parke
County for parcel of land and a pottery kiln thereon but he failed to make a
sale on the order granted? on said petition. that he made every
exertion to find a purchaser for said certificate and finally sold the land to
Eliza Wilkins for $85.00 that being the highest and best bid he ? ? for
the same that had he taken a deed to said land with said certificate and
applied to same court for an order to sell said land he would not have been
able to obtain over and above the costs of said application a sum to exceed
$85.00, therefore asks an order confirming and He further states that after
paying the Expenses of Administration, Taxes and funeral expenses there remains
in his hands the sum of $151.49 for distribution among the creditors. that the claims
filed and allowed against said estate is due for $116.50 in favor of John A
Goldsberry of which sum $57.00 was found by the Court to be a preferred claim
for expenses of medical attention in the last sickness of Deceased. that the said Adm
sold the real estate of decedent under the order of the Court to pay the debts
of said decedent, among which is the following judgements taken in the lifetime
of the decedent which were levies against the said lands towit,

said lands to pay said liens and he pays into Court said sum of $151.49 and
asks a order of Distribution of the same among said creditors. He further shows that the preferred claims
will exhaust said sum leaving nothing to pay on the general and unsecured
claims and having fully executed his Trust he asks a discharge of the same.

true and complete exhibit of his administration of said Estate and a complete
statement of the receipts and expenditures therein with the exceptions of such

Adm of said estate shows to the court that on the 1st day of January 1880 he
obtained a judgement and ? of foreclosure in favor of
said estate against Wm Hendrick and Martha Hendrick his wife for $191.55 &
costs, taxes at &76.64 at date of execution and an order of sale of part of
the SW1/4 of sec 3 Town 16 N Range 8 West described as commencing at the SE
corner of said 1/4 section, thence west 76 rods, thence North 10 rods, thence
east 16 rods, thence South 10 rods to place of beginning containing one acre
more or less. that
on the 21st day of February 1880 said land was sold on said ? after a notice by the Sheriff of Parke County and no one
bidding on said land except the said Adm the same was bid in by him for the sum
of & 268.19 and a certificate was issued to him by said Sheriff. That said Deft has not ?
said land ? ? expires on the
s of February 1881 that ? other property on which levy
of said Deft. That he has an offer of $250 for said certificate that there is
an unpaid $58.00 delinquent tax against said land which a ?
That the said offer of $250 is made with the condition that the Ad pay said taxes. He further ? that he believes that it is for the best interests of the
estate that said certificate be sold on the terms aforesaid and he asks an
order accordingly.

Comes
now William EB Sewell by DH Maxwell his attorney and files his exception to so
much of the Final Report of Milton Robinson Ad of the Estate as distributes the
sum of two hundred thirty six and 85/100 dollars to Eliza Wilkins Widow of
decedent said amount being part of the proceeds of the sale of two thirds of
the real estate of which decedent died seized and sold by said Ad for payment
of debts of decedent and said amount being distributed to her by the Ad to make
up the deficiency of the personal estate of decedent to satisfy the Widows
claim of Five hundred dollars
He states that in decedents life
time, and on the 13th day of October 1876 in the Parke Circuit Court he
recovered a judgment on a note against decedent for the sum of $643.23 and for
costs 10.05 without relief from valuation and appraisement - that on the 15th
day of Nov 1876 an execution was issued on said judgment - That said judgment
in the life time of decedent became a lien and was at his decease a lien on the
real estate so sold by the Ad for payment of debts and he alleges that the lien
of his judgment had and has priority over the lien of the said Eliza Wilkins on
the real estate so sold and as against the said amount of $236.85 should be applied
and paid on his said judgment. DH

Comes now the
Plaintiff by Messrs Rice and Johnston, his attorneys and also come the
Commissioners hence aforesaid and file their Report duly acknowledged in open
Court, Which Report in the ? and figures following
towit:
the undersigned commissioners
appointed by the Parke Circuit Court at the March Term 1879, to make partition
of foregoing described Real Estate, having ben duly sworn have discharged the
duty assigned us and submit our report as follows. We having examined said premises do hereby
set off and assign to the said Eliza Wilkins defendant as her one third of said
Real Estate the
following described portions thereof to wit: A part of the West half of the
NorthWest quarter of Section Twelve (12) Township Sixteen (16) North Range
Eight (8) West Bounded as follows. Commencing Twenty three (23) rods West of
the North West Corner of the Original plat of the Town of Annapolis running
thence West Seven (7) rods, thence South ten (10) rods, thence East seven (7)
rods, thence North ten (10) rods to the place of Beginning. We also set off and assign to said defendant Lots Number forty seven (47) Number forty
