George Wilkins Plaintiff complains
of William A Nickell and James H Moore Defendants and says that on the 15th day
of September 1868. The Defendants executed to Pttff then two promissory notes
calling for $16666.66 each due in two and three years respectively from
date. That on said day they also executed
to Pttff a mortgage conveying to Pttff the tract of land therein described as
security for the debt evidenced by said note and one other of the same amount
which has been paid off. Said note being executed for the purchase money of said tract of
land. Which notes and mortgage are filed herewith and made part of this
complaint together with interest therein, except the sum of $300 paid August
22nd 1871, also $100 paid May 30th 1873, also $50 paid August 23rd 1873, also
$312.39 paid August 20th 1874, also $102.50 paid May 31st 1875 Which are
endorsed on said note deed two years of the date. Wherefor Plaintiff demands judgement for
$4000 the foreclosure of said mortgage and the sale of the land or so much as (remainder not
found)
This Indenture,
Witnesseth, that William A Nichols and James H Moore of Parke County in the
State of Indiana Mortgage and Warrant to George Wilkins of Parke County in the
State of Indiana the following Real Estate in Parke County in the State of
Indiana, to=wit: A part of the East half of the South West quarter of Section
Twenty (20) in Township Seventeen (17) North Range Seven West viz Commencing at
the South East corner of Said quarter thence West to Mill Creek thence up said
creek with the meandering of the same to the East line of said quarter thence
South 47 poles to place of beginning and the South East quarter of the South
East quarter of said Section Town and Range and the West 1/2 of the South East
quarter of said Section Town and Range, excepting in the last named ? 3 acres
viz Commencing at the North West corner
of said half quarter, thence South 34 poles, thence East 14 poles, thence North
34 poles thence West 14 poles, containing 120 acres, to secure the payment,
when they become due of three promissory notes given for the purchase money on
the above described land of even date herewith for Sixteen hundred and Sixty
Six and 66/100 Dollars each and due in one, two and three years with six per
cent interest from date executed by mortgages to mortgagee and the mortgagors
expressly agree to pay the sum of money above secured without relief from
valuation laws.
In witness whereof, the mortgagors have
hereunto set their hands and seals, this 15th day of September 1868
