vs Clement Lee, et al per to sell land

Comes now the said petitioner by T. V. Thornton Esqr. his solicitor and files the assent in writing of John H. Leatherman, Mary Leatherman, Martin Cutsinger, Isaac Lee, Clement Lee, C. P. Leatherman, Elizabeth Leatherman, Avrilla Lee, Elisha Cutsinger, Jackson Cutsinger, Harrison Case, Nancy Case, Delila Cutsinger, William Smith, Elizabeth Smith, heirs at law to the sale of the land as in the petition mentioned and at the same time said soliciter files the affidavit of disinterested person that Moses Lee one of the dependents hereto is not a resident of the state of Indiana, it is therefore ordered by the court, that notice of the pendency of this suit be given to said non resident dependant by publication in the "Patriot" a newspaper of general circulation published in Paoli, in Orange County, Indiana, for three weeks successively to notify said dependant to be and ear(?) on the first day of the next term of this court, and then and there to plead answer or demur to said petition or in default thereof the matters and things therein contained, called in his absence and this case is until the next term of this court convened(?).

Administrator makes sale of the said land at the premises in the petition mentioned at public vender.
Sec 36 in township 3 north first giving 30 days notice by posting up in three of the most public places in the township where said land is situated and also on the courthouse door in the town of Paoli and some other public place in said county, time and place and terms of sale and take from the purchaser bonds payable in three equal installments at 6, 12, and 18 months and this cause is continued."

Comes now said petition by Thom. V. Thornton Esqr. his solicitor and the court being satisfied by the sheriff return herein that Delilah Lee, John Cutsinger, Mary Krutsinger, Rhoda Krutsinger, Melinda Krutsinger, Ranson Brown, William Brown, Avrilla Brown, Aaron Brown, Sally Brown, have been duly served with process and also files the affidavit of Marshall D. Maxwell setting forth that notice of this proceeding was published in the Patriot a newspaper printed and published in the town of Paoli, Orange County’ for three weeks successively commencing on the 6th day of June and ending on the 27th day of the same month, and also files the assent in writing of John H. Leatherman, Mary Leatherman, Martin Cutsinger, C. P. Leatherman, Elizabeth Leatherman, Arvilla Lee, Elisha Cutsinger, Isaac Lee, Clement Lee, Jackson Cutsinger, William L. Smith, Elizabeth Smith, Harrison Case, Nancy Case, Delila Krutsinger, to a sale of the land in the petition mentioned according as the court may direct and Moses Lee although thence solemnly called comes not but makes default whereupon the said petitioner by his said solicitor suggests the court that John Cutsinger, Mary Cutsinger, Rhoda Cutsinger, Melinda Cutsinger, Ransom Brown, William Brown, Avrilla Brown, Aaron Brown, and Sally Brown are dependants wheresaid and are minors under the age of twenty-one years and thereupon the court appoints Arthur J. Simpson guardian ad letum for said minor dependents, who comes into open court accepts said appointments and files his answer to said petition and said administration now files additional bond conditional according to law in the penal sum of eight hundred dollars . .
