Deeter - Elizabeth

Final was written last week in the suit of Clyde D. Burk against Jackson Deeter in which the plaintiff demanded the payment of a $1,000 note give him by Elizabeth Deeter, mother of Jackson Deeter. The case was tried in the Montgomery Circuit court and was decided in Burk’s favor whereupon the defendant carried the case to the appellate court. Here the decision of the lower court was sustained and a motion for a rehearing was asked this being overruled last Thursday and the suit ended. Before her death, Elizabeth Deeter gave three notes of $1,000 each to Clyde B. Burk, Jennie Deeter and Edna Deeter, the notes carrying the statement that they should become payable six months after her death. Jennie and Edna Deeter are her brother’s children; I Clyde Burk an orphan boy whom | she had reared from infancy. When the notes became due Jackson Deeter, the only heir at law of Elizabeth Deeter, refused to pay I the notes and suits were hied. The case of both Jennie and Edna Deeter have not as yet come to trial, the cases having venued to Tippecanoe county and are set for trial next month.- kbz
