The second suit is that of Mary E. Devine vs. Joseph N. Workman et al and is for $10,000 damages.  Frank E. Gilkison is the attorney for the plaintiff and Padgett & Padgett, Fabe Gwin and Hiram McCormick are the defendant's attorneys.  The plaintiff is the widow of James A. Devine, who on November 5, 1910, fell from the second story of a restaurant in the town of Loogootee, suffering injuries which caused his death on November 8, 1910.

She charges that the defendants, Joseph N. Workman, Alpheus D. Toon, Sherman McPherson and Bernard Seal unlawfully and wrongfully gave to her husband intoxicating liquors, as the result of which the said James A. Devine became intoxicated, unconscious, and uncontrollable.  That while in said condition he fell fifteen feet from the second story of a restaurant onto a concrete pavement, sustaining injuries that caused his death.  Wherefore she demands a judgment against the defendants for the sum of $10,000.
