LAST WILL OF CHARLES D. WINEINGER

 
I, Charles D. Wineinger, a resident, of Ireland, Dubois County, and state of Indiana, and being of sound and disposing mind and memory, do make, publish and declare this to be my last Will and Testament, hereby revoking any former wills by me at any time made. ITEM ONE: It is my will and I direct that all my just debts be first paid.

ITEM SECOND After my said debts are paid, I give and bequeath to my beloved wife, Ida. E. Wininger, one-half of all money, notes, bonds, shares and accounts and stock that I may own or have at the time of my death.

ITEM THREE: I give, devise and bequeath to my said wife, Ida E. Wininger, absolutely in fee simple, the following described real estate, situated In Dubois County and State of Indiana, being my home and residence where I now live, it being all the real estate I now own in said Dubois County, to wit: Lots numbered fifteen (15) and sixteen (16) in Corn's Addition to the town of Ireland, said County and State, according to the plat or chart of said addition to said town.

ITEM FOUR:    I, further, devise and bequeath to my said wife, Ida E. Wineinger, Five Hundred Dollars ($500.00) in cash as a special bequest. This Five Hundred Dollars ($500.00) is to be a first lien on lots and property I own In Evansville, Indiana, and hereinafter In this will described.

ITEM FIVE: I give, devise and bequeath to my said wife, Ida E. Wineinger, all of my personal effects such

as my household Id furnishings. ITEM SIX:_    I give, devise and bequeath, to my daughter, Queenie C. Spangler, as a special bequest, One Thousand Dollar ($1,000.00) equalize her with her two brothers, Ray F. Wineinger and Havilla C. Wineinger, to each of whom I have given one Thousand Dollars ($1,000.00). This One Thousand Dollars ($1,000.00) to Queenie C. Spangler as a special bequest is to be a second lien on lots and property I own in Evansville, Indiana, and hereinafter in this will described, and is to be first to said Queenie C. Spangler from rents and proceeds of sale of Evansville, Indiana, property.

ITEM SEVEN: I give, devise and bequeath absolutely in fee simple to my three children, Ray F. Wineinger, Havilla C. Wineinger and Queenie C. Spangler, subject to the amount and special bequest to said Ida. E. Wineinger and Queenie C. Spangler in Items Four and Six of this will, the following described real estate and property^ situated in the city of Evansville, Vanderburg County and State of Indiana, according to the plat city, to wit: Lot Number Eleven (11) in Block Number Eight (8) in Hopkin's Place, and addition to the city of Evansville, Vanderburg County and State of Indiana according to the recorded plat thereof, property commonly known as 1560 South Morton Avenue, Evansville, Indiana. After said Ida E. Wineinger and Queenie C. Spangler have received the special bequest as set out In Items Four and Six of this will, then I devise and bequeath In fee simple, share and share alike, to my said children, Ray F. Wineinger, Havilla C. Wineinger and Queenie C. Spangler, the one lot and property In the City of Evansville, Indiana, above described. The said Queenie C. Spangler is to get the said   amount as set out In Item Six of this will, more than either of her said brothers, Ray F. Wineinger or Havilla C. Wineinger, to equalize her with what her said brothers have each heretofore received.

 

ITEM EIGHT: I give, devise and bequeath to my said children, Ray F. Wineinger, Havilla C. Windinger and Queenie C. Spangler, share and share alike In equal shares, all the rest and remainder of my estate no matter what it may consist of nor where situated.

Proof Of Will

STATE OF INDIANA COUNTY OF DUBOIS, SS:

Before me, Eldo W Wood, Judge of the Dubois Circuit. Court personally came

L. B. Johnson, One of the subscribing Witnesses to the foregoing last will and testament of Charles D.

Wineinger, late of Dubois county, Indiana, deceased, and he being duly sworn, says that, he was present

at the execution of said last will; that the same was duly exe uted; that at the time of the execution

thereof, said decedent was of full age to devise his property, of sound mind and memory, and was not

under coercion or restraint that said decedent requested Logan Morgan, and this affiant, to sign said

will as witnesses thereto, which they accordingly did in the presence of said decedent and in the presence of each other, as subscribing witnesses thereto. Affiant further says on his oath that said decedent died testate June 22, 1938, and was a resident of Dubois County, Indiana, at the time of his death.
